Terms of Service
These Terms of Service (hereinafter referred to as the "Terms") define the conditions for using the service "IvyBOT" (hereinafter referred to as the "Service") provided by Ivywe Inc. (hereinafter referred to as the "Company").
Article 1 (Application)
These Terms shall apply to all relationships between the User and the Company regarding the use of the Service.
Article 2 (Paid Services and Points)
- The Service allows users to use functions such as image processing by consuming individually purchased "Points". The number of points consumed shall be as specified on each tool or the pricing page of the Service.
- In the event that unused points remain in a subscription plan, they may be carried forward to the following month or later, provided they are within the expiration date of said points. Details shall be subject to the provisions of each plan.
- Expiration of Points
- The expiration date of points shall be as follows, depending on their type:
- Standard Points (purchased, etc.): Points expire 180 days from the time of purchase.
- Limited-time Points (Omikuji, etc.): Points until 23:59:59 on the day they are granted.
- Points that have passed their expiration date will automatically expire and cannot be refunded or reinstated.
- When using points, they will be consumed in order starting from those closest to their expiration date.
Article 3 (Payment and Refunds)
- Fees for the Service shall be processed through PayPal.
- Due to the nature of digital content and services, no refunds, cancellations, or returns will be accepted after the payment is complete.
Article 4 (Copyright and Intellectual Property Rights)
- Copyright for images uploaded by the User to the Service shall remain with the User.
- Rights to images generated or processed by the Service shall also belong to the User. However, the User acknowledges that legal copyright may not arise for AI-generated products in some cases.
Article 5 (Prohibited Acts)
Users must not engage in the following acts:
- Processing images that violate public order and morals.
- Acts that infringe upon the intellectual property rights or privacy of third parties.
- Acts that place an excessive load on the Service's servers or networks.
Article 6 (Disclaimer)
The Company does not guarantee that the Service is free from factual or legal defects. The Company shall not be liable for any damage caused to the user through the use of the Service, except in cases of intentional misconduct or gross negligence by the Company.
Service interruptions due to maintenance or server load may occur without prior notice.
Article 7 (Exclusion of Anti-Social Forces)
- The User represents and warrants that they do not currently fall under, and will not in the future fall under, any of the following categories: organized crime groups, members of organized crime groups, persons for whom five years have not elapsed since they ceased to be members of organized crime groups, quasi-members of organized crime groups, companies related to organized crime groups, corporate racketeers (Soka-ya), groups engaging in criminal activities under the guise of social movements, or special intelligence-based organized crime groups, or any other equivalent persons (hereinafter collectively referred to as "Anti-Social Forces"), and that they do not fall under any of the following categories: (1) Having a relationship where Anti-Social Forces are deemed to control the management. (2) Having a relationship where Anti-Social Forces are deemed to be substantially involved in the management. (3) Having a relationship deemed to involve unjust utilization of Anti-Social Forces for the purpose of seeking illicit gain for oneself, one's company, or a third party, or for the purpose of inflicting damage on a third party. (4) Having a relationship deemed to involve providing funds or convenience to Anti-Social Forces. (5) Having officers or persons substantially involved in management who have socially condemnable relationships with Anti-Social Forces.
- In the event the Company determines that the User has violated any of the representations or warranties in the preceding paragraph, the Company may, without any prior notice, suspend the use of the Service or terminate the usage contract for the Service.
- The Company shall not be liable for any damage caused to the User as a result of measures taken by the Company based on the preceding paragraph.
